What is Bankruptcy?

Bankruptcy is a legal proceeding that can give you or your business a financial fresh start when bills cannot be paid. Different Chapters in Bankruptcy represent different types of plans available to debtors. Most individuals generally file either a Chapter 7 or Chapter 13 Bankruptcy case and Businesses generally file under Chapter 11 of the Bankruptcy Code.

A Chapter 7 Bankruptcy otherwise known as "liquidation," is generally the simplest and quickest form of Bankruptcy and is available to individuals, married couples, corporations and partnerships. A Chapter 7 Bankruptcy is designed as an orderly, court-supervised procedure by which a Trustee collects the assets of the debtor's estate, reduces them to cash, and makes distributions to creditors, subject to the debtor's right to retain certain exempt property and the rights of secured creditors.

A Chapter 13 Bankruptcy is a debtor repayment plan and is available to individuals, married couples, and sole proprietors. In a Chapter 13 Bankruptcy, a debtor proposes a plan to repay creditors over a three to five year period during which the debtor can make up overdue payments on any assets and pay into the plan the equivalent value of any assets not covered by exemptions. Since the debtor's plan will require regular monthly or biweekly payments, Chapter 13 is usually only appropriate for an individual debtor who has a regular source of income. Chapter 11 Bankruptcy is a restructuring and debtor payment plan for corporations, LLC's and other entities.

Which Chapter is right for you?

Determining which Chapter is right for you can be a complex and difficult process, especially with the new complex Bankruptcy laws. However, at Cossidente & Salus, Ltd., we provide free consultations to help you understand the difference in the Chapters, as well as provide you with guidance as you attempt to free yourself of your financial burdens.

Why should you choose Bankruptcy?

Bankruptcy can occur for a variety of reasons. Many times people must file Bankruptcy for reasons beyond their control. Employment problems, unpaid medical bills, divorce, and overwhelming credit card debt are just a few of the common reasons. Many people are tricked into believing they have alternatives to filing Bankruptcy only to find themselves deeper in debt. Debt consolidation does not work. Bankruptcy offers the protection of the Court and can stop foreclosure proceedings, stop harassing creditor phone calls and stop wage garnishments. Debt consolidation cannot and does not stop any of these.
